It's highly likely that they would and could without consequences but is not guaranteed. I don't think I'd want him, not because he isn't good enough but to be charged and convicted of 2 seperate assaults in 2 seperate incidents not that long after being convicted of assault previously is not the sort of behaviour I'd want from an employee.
