On 26 Feb 2013, Oliver refereed the FA Cup replay between the mighty Everton and the minnows of Oldham Athletic. The only way in which Oliver could have been more of a homer would to have painted himself yellow and gone on carrying a tin of Duff. He awarded a pretty fair penalty to the toffees but turned down an equally fair penalty to the, original, Latics. For Everton's third, and probably tie settling goal, he awarded a throw in to EFC where it was a clear Oldham throw. Sealing a poor night he signalled three minutes of stoppage time when there were 6 substitutions, 2 goals and 2 minutes of treatment to Tim "Brittle" Howard in the second half.
