Car accident

I know it is not football related, but I know others air their views and I know quite a few on here. I had a car accident on Monday when a car hit me from behind at quite a speed and shunted me into the one in front. As a result of this, I have whiplash, and am currently on the sick. Everyone (family and friends) tell me I should be pursuing a personal injury claim, as the lady who hit me has admitted full responsibility. My car has £2,500 worth of damage.

 

Has anyone been in this position, and does anyone have any advice? I am in no way the sort to claim what I can get in this compensation climate, but two friends I have spoken to have had neck problems years down the line, so I am also thinking about the future. Also, with my nerves in tatters, I am hoping I can get to the first game (getting my priorities right of course!) as I have not missed the first game for as long as I can remember.

 

Over to you lads and lasses, and hope you are all having a better closed season than me, as this is my 2nd sickness absence in two months! After 5 years of a 100% work attendance rate.

I was in a bus crash at 17 and still have neck problems at 25. But no money would fix that so, as you rightly say, it's a question of morals regarding if you think you're entitled to the money.

 

I'd say juts make sure you get better more than anything else!

I would contact your insurers who will undoubtedly recommend a good solicitor to pursue a claim for loss of earnings etc. If the driver admits liability (which he must in this case) all will come from his insurer anyway. I have known people in the same situation and they received a tidy sum, but most importantly have had the correct medical advice and treatment. Good luck Cherry !!!

Every bugger else does it and your case sounds genuine, screw 'em for every penny you can get! The wife was hit at speed while stationary at lights she was pregnant with my daughter at the time, everything was ok but my wife has had back, hip and neck problems since.

No the people who see a broken pavement and fake injury need to blame themselves.

 

Or parents who sue when their kid bumps there head on a climbing frame...

 

Personal responsbility dosent exist any more...

My mate had a little crash when his stearing lock went on whilst moving. He then proceeded straight on at a bend into a works van. The three burley blokes get out one stating "You've ****ed my van". My mate gets out, explainging why the accident had occured and asking if everyone was okay. "Yeah, we're all fine".

like has already been said,speak to your insurer and they will put you in contact with a good soliciter,you will have to fill out a fair few forms,be sent for a medical and so on,normally TAKES AROUND 12 MONTHS TO SORT EVERYTHING OUT,and p.s. dont take first offer ;) but the soliciter will advise all the way through

Sorry to hear of your accident Cherie, hope you can make it to the first game!

 

I agree with everyone on here. You didn't ask for your car to be shunted in the back, causing you injury and time off work. It's only right that you are compensated for this. Get intouch with your insurers and they'll sort it all out. It does take a while though for everything to be sorted out though. It took a good 12 months for my car accident claim to be sorted.

get in touch with your insurers they will have their own favourite solicitors who specialise and they will get them to pursue any claim for you. make sure you have full medical reports on any treatment you have. One concern would be that the other person has accepted responsibility. her insurance company may well have a clause in her policy stating that if the insured does this then they are no longer covered and then personally liable for any claim.

Was in the position 7 years ago, the insurers will try to settle within 12 months, because after that any lasting damage comes to the surface. DONT if you have twinges, settle! My Dad is the same,two years on after settling, he is on pain management for life!, you cannot go back and claim!

Back in 2005 my wife (fiance at the time) was in an accident. She was shunted from behind by a young lady who's kids were mivering in the back and she was properly paying attention. She only hit my wife at about 15 MPH, but it did give her whiplash and she was off work for 4 days and on painkillers for two weeks. She had a first offer of £1.7 K, which her soliceter told her not to accept, the next offer was £2.1 K and her soliceter told her it would be better to take it rather than end up with less if it went to court.

 

The money ended up paying for our honeymoon, but I can safely say the two weeks in Florida we had (as nice as it was) was not worth the two weeks of pain my wife was in, where she could barely move and her loss of confidence behind the wheel when driving. I would easily have forgone the honeymoon to Florida for my wife to have never been in that accident.

 

I say take every penny you can get. The physical injuries aren't the only thing. Unless you are some kind of robot, it will effect your confidence when driving (more in other people than your own ability) at least for a short period of time and possibly longer.

Your insurance company will advise you on making a claim. I f you have taken out drivers legal protection when you took the policy they will do all the

donkey work employing solicitor etc. You would only have to see a consultant later down the line for an examination...will take about 10 mins if my experience is anything to go by. You are entitled to compensation end of story. The wonan who hit you will not be paying and she will be feeling bad enough anyway. Whiplash can affect you for years....I still have some limitation in my neck movement some 8 years later. Should get just over 2000 quid out of it at least.

me and a few others had a crash on the M40 (i think) on the way to the QPR play off game, quite a frightening experience really (this was after spending 3 days in Amsterdam, and travelling down straight from Liverpool airport which was the very very last thing we needed!!)

 

we all claimed for whiplash off the van driver (who drove into the back of us), if i remember rightly it was quite straight forward

I'm coming to come across as the devil's advocate here. But before I start I'm sorry the OP got hurt and I hope they get better soon and this in no way reflects on them but...

 

People who put in false claims (or exagerrated claims) for personal injury put the price up for everyone be it on insurance or council tax (lawyers don't come for free etc. and the actual costs of legal proceedings can be very very high). I've been involved in a situation where the other party claimed whiplash (despite it really being their fault) and I would hope that the lawyers/whoever involved put him through the wringer to find out he was quite a bit of a :censored: (how you claim whiplash when you say to the cops you aren't hurt is beyond me). I would imagine that depending on the size of claim the more the hassle you get (they probably won't hassel you that much for something that's not worth it) so the bigger the claim be prepared for a bit of hassel (if they can pay a lawyer £5k to save themselves £20k etc. they will and the lawyers will be ruthless). I'm really really really etc. not a big fan of people who claim flase injury (or exagerrate it) and if you are pulling a fast one I would make sure you get the right doctor (some have the same opinion as me but other have far less scruples). An interesting tidbit I heard was that in countries without car insurance whiplash doesn't exist (make of that what you will).

 

I would advise the original poster to get their story straight and written down on exactly what happened (computers are really helpful for this) and to liase with the insurers (essentially if the other person has already admitted libility).

Quite a lot of rubbish posted on here such as insurers not paying out if a driver accepts liability and also the fact that the insurers will look to settle within 12 months.

 

Injury claims are assessed on the nature of the injury (naturally) the amount of disruption it will cause to your general quality of life, the knock on effects felt by any dependents and also the rehabilitation period.

 

Insurers will look to settle as soon as possible but they are no mugs. Full medical reports will be required and some form of physiotherapy report detailing how long your injury will take to recover and also the type of exercise required to acheive this.

 

As has been mentioned if you have legal protection then your insurer will be able to appoint a solicitor on your behalf who will co-ordinate the medical side of things and negotiate settlement on your behalf. Insurers use a set system called colussus to assess what value should be placed on the injury and any settlement awarded.

 

Failing that most solicitors will take on what would appear to be a straightforward case but beware as there are a lot of dodgy ones out there.

CLAIM !!!!!

 

Back in 94 i was in a crash which was my mates fault. Not going to go into details of my injuries but lets just say i was in a bad way and he never came to visit me in hospital. Turns out my mate wasnt insured as his missus had cancelled it when they split up the week before. I was told i would get something in the region of 30 - 40K if i took him to court for it. I refused to do it as he was a mate. More fool me, within 2 years he had cheated my mum and dad out of £400 and i didnt see him again for a long time. If i knew then what i knew now i would have took it to court without a doubt.
