Then latics / OMBC decided to agree so that the land swap could be proposed. So, the Charity Commission have "decided" that it is indeed a charitable trust; which no-one was actually disputing. Well done. How much time did they spend coming up with that? Meh. Does anyone know who in OMBC is supposed to be taking a lead on this debacle of procrastination? Now, as stated in the email from the Charity Commission, the CC has to consider: (1) whether the decision taken by the Failsworth Trust Committee (two Councillors plus one who left the meeting before the decision was taken, after declaring an interest as she had taken part in a cabinet meeting on the subject earlier this year), who did not visit the sites, is a fully informed decision, taking into account all relevant factors, and setting aside irrelevant factors; and (2) whether the Council, which delegated the decision to Councillors, who had been involved in cabinet decisions regarding the proposed stadium development, and did not include Failsworth representation, has taken sufficient steps to manage the various conflicts of interest affecting the proposed transaction. The Failsworth residents and Councillors have expressed concern in the rarely-wrong Chron about whether the Trust Committee’s actions will stand up to scrutiny. As also stated in the email, the CC will eventually decide one of the following: (i) to proceed based on the information already received; or (ii) to withhold authorisation because certain information is lacking (but leaving it open to the Council to re-apply if the missing information can be supplied); or (iii) to refuse authorisation on the facts as they stand.
