Even if the footage was bravado and he was simply trying to get out of a threatening situation, the fact that he managed to get in that kind of situation in the first place was enough for me to want him as far away from the club as possible. I met him a few times whilst in my old job too, he always came across as a decent bloke. He had it all, nice partner, young baby and a good career. We are all entitled to our opinion and the video evidence is there to be viewed. But take caution that if there is litigation ongoing you not only place yourself but also OWTB and even the Club at risk of being damaged by it. We will of course do the best we can to mitigate posts which break the rules but we can't guarantee that, of course. Thanks as always. slystallone Posted November 24, 2014 Share Posted November 24, 2014 At the time, it was alluded to that other factors, not just the video evidence of the spot fixing, was behind the clubs decision to sack him. Corney on that piece also quite strongly states it again. There is clearly more to this than merely the spot fixing, which was IMO more than enough to fire him for. In the unlikely event that he wins, we've got a probable easy win against Mr Mahmood aka The Fake Sheikh. In fact if the spot fixing scandal has no merit whatsoever, even if we beat Montano we'd have a pretty good case against Mahmood, and the Paper he was working for. Personally I did think Montano's sacking was a bit hasty at the time, but we'd have been easily within our rights to suspend him without pay. As his contract was up in June, that wouldn't have gotten renewed, therefore it becomes a not so difficult case to defend, especially given the rape allegation and some obvious other misdemeanours too. Montano has to prove that no reasonable employer wouldn't have sacked him, and although he was the only one sacked that was accused in the same incident, I think one or two were without clubs and most of the others didn't get their contracts renewed in the summer. Lawfully you have to prove beyond reasonable doubt that you are guilty. In employment law that is not the case. It is based on probability and if the club can prove he probably did it then they will be fine. The fact he's on video i would say shows he probably did it!
